  1. This is a legal agreement between you (either an individual or an entity) 
  2. and Microsoft Corporation ("Microsoft"). Microsoft reserves all rights not 
  3. expressly granted.
  4.  
  5. The following discussion concerns redistributable components of Win32s, 
  6. hereafter referred to collectively as REDISTRIBUTABLE COMPONENTS.
  7.  
  8. The following files, identified as "Group A," define the Win32s components. 
  9. Group A is a subgroup of the REDISTRIBUTABLE COMPONENTS. All of these files 
  10. must be installed on Windows 3.1 or Windows for Workgroups in order to run 
  11. Win32 applications. You must ship and install all of these components with 
  12. a Win32s application in accordance with the installation instructions in the
  13. Win32s Programmers Reference as part of the Microsoft Win32 SDK:

  21. You must also ship Natural Language Support files corresponding to the 
  22. market of the Win32s application. For a Win32s application which has an 
  23. international market, you must ship all of the .NLS files found in 
  24. \MSTOOLS\WIN32S\NLS. For instance, a Win32s application which is released 
  25. only in the United States must ship P_437.NLS, P_850.NLS, and P_1252.NLS.

  27. The following files, identified as "Group B," are supplied along with the 
  28. Win32s components as a sample Win32 application.  Group B is a subgroup 
  29. of the REDISTRIBUTABLE COMPONENTS. You may redistribute these files with 
  30. your own Win32s installation program. You may not ship these files separately
  31. from the files listed above as Group A.

  34. The following files, identified as "Group C," can be shipped as-is, or used 
  35. by you to derive your own Win32s Setup program.  Group C is a subgroup of 
  36. the REDISTRIBUTABLE COMPONENTS.:

  42. With respect to the REDISTRIBUTABLE COMPONENTS (including any modifications 
  43. to group C files), Microsoft grants you a nonexclusive, royalty-free right 
  44. to use, reproduce, and distribute the object code version of these files, 
  45. provided that you:
  46.     1. Distribute the REDISTRIBUTABLE COMPONENTS only in 
  47.        conjunction with and as a part of your software product -- such 
  48.        software must add significant and primary functionality to the 
  49.        REDISTRIBUTABLE COMPONENTS and must be designed, developed and 
  50.        tested to operate in the Microsoft Windows or Windows NT 
  51.        environments
  52.     2. Do not use Microsoft's name, logo, or trademarks to market your 
  53.        software application product;
  54.     3. Include a copyright notice for your software application product 
  55.        sufficient to protect Microsoft's interest in the 
  56.        Redistributables;
  57.     4. Agree to indemnify, hold harmless, and defend Microsoft from and 
  58.        against any and all claims or lawsuits, including attorney's 
  59.        fees, that arise or result from the use or distribution of your 
  60.        software application product. The license in this section to 
  61.        distribute REDISTRIBUTABLE COMPONENTS is royalty-free provided 
  62.        that your software product is designed, developed and tested for 
  63.        operation in the Microsoft Windows or Windows NT environments. 
  64.        Contact Microsoft for the applicable royalties due and other 
  65.        licensing terms for all other uses and/or distribution of the 
  66.        REDISTRIBUTABLE COMPONENTS.

  68.     5. Do not permit further distribution of the Redistributables by 
  69.        your end-user customers.
  70.  
  71. LIMITED WARRANTY
  72.  
  73. NO WARRANTIES.  To the maximum extent permitted by applicable law, Microsoft 
  74. expressly disclaims any warranty for the SOFTWARE.  The SOFTWARE and any 
  75. related documentation is provided "as is" without warranty of any kind, 
  76. either express or implied, including, without limitation, the implied 
  77. warranties or merchantability or fitness for a particular purpose.  The 
  78. entire risk arising out of use or performance of the SOFTWARE remains with 
  79. you. 
  80.  
  81. CUSTOMER REMEDIES.  Microsoft's entire liability and your exclusive remedy 
  82. shall not exceed the price paid for the SOFTWARE. 
  83.  
  84. NO LIABILITY FOR CONSEQUENTIAL DAMAGES.  To the maximum extent permitted by 
  85. applicable law, in no event shall Microsoft or its suppliers be liable for 
  86. any damages whatsoever (including, without limitation, damages for loss of 
  87. business profit, business interruption, loss of business information, or any 
  88. other pecuniary loss) arising out of the use or inability to use this 
  89. Microsoft product, even if Microsoft has been advised of the possibility of 
  90. such damages.  Because some states/jurisdictions do not allow the exclusion 
  91. or limitation of liability for consequential or incidental damages, the 
  92. above limitation may not apply to you. 
  93.  
  94. U.S. GOVERNMENT RESTRICTED RIGHTS
  95.  
  96.     The SOFTWARE and documentation are provided with RESTRICTED RIGHTS.  
  97.     Use, duplication, or disclosure by the Government is subject to 
  98.     restrictions as set forth in subparagraph (c)(1)(ii) of The Rights 
  99.     in Technical Data and Computer Software clause at DFARS 252.227-7013 
  100.     or subparagraphs (c)(1) and (2) of the Commercial Computer Software 
  101.     -- Restricted Rights at 48 CFR 52.227-19, as applicable.  
  102.     Manufacturer is Microsoft Corporation/One Microsoft Way/Redmond, 
  103.     WA 98052-6399.

  105. If you acquired this product in the United States, this Agreement is 
  106. governed by the laws of the State of Washington. 
  107.  
  108. If you acquired this product in Canada, this Agreement is governed by the 
  109. laws of the Province of Ontario, Canada.  Each of the parties hereto 
  110. irrevocably attorns to the jurisdiction of the courts of the Province of 
  111. Ontario and further agrees to commence any litigation which may arise 
  112. hereunder in the courts located in the Judicial District of York, Province 
  113. of Ontario.

  115. If this product was acquired outside the United States, then local law may 
  116. apply.
  117.
